Advisory Statement
Construction disputes do not always begin as disputes. In many cases, they start as misalignments that owners hope can be resolved through communication and clarification. PG38 Development was first brought into the James Pole Barn project to help bridge differences between the owner and the original contractor.
When resolution efforts failed and the contractor did not honor or complete the agreed-upon scope, PG38 Development transitioned from advisory support to corrective action, documenting conditions, stabilizing the project, completing the build, and preparing detailed reporting to support legal recovery.
Client Background & Project Context
The James Pole Barn involved a privately funded pole barn project intended to support the owner’s functional and long-term property needs.
At the time PG38 Development was engaged, construction had already progressed far enough that concerns were no longer hypothetical. The owner was facing uncertainty around what was included, what should have been expected, and how to address perceived deficiencies without escalating the situation unnecessarily.
The Situation
At the time of PG38 Development’s initial engagement, the project was experiencing growing tension between the owner and contractor. Key issues included:
- Disagreement over scope and completion expectations
- Concerns regarding incomplete and stalled work
- Deteriorating communication between parties
- Uncertainty around whether issues could be resolved without escalation
PG38 Development was first engaged to help clarify expectations and support resolution before the situation escalated further.
Why PG38 Development Was Brought In
The owner initially sought PG38 Development’s assistance to resolve differences and restore forward progress without terminating the contractor relationship.
When those efforts proved unsuccessful and the contractor failed to complete the work, the owner required a second level of support:
- Independent documentation of existing conditions
- Clear identification of incomplete and deficient work
- Leadership to bring the project to completion
- Construction-based reporting suitable for legal review
PG38 Development’s role expanded accordingly.
PG38 Development’s Strategic Approach
PG38 Development approached the project in two distinct phases.
Phase One: Resolution Effort
- Reviewing project status and scope expectations
- Identifying areas of misalignment
- Supporting communication aimed at resolution
Phase Two: Remedy, Documentation, and Completion
- Thoroughly documenting existing conditions and deficiencies
- Separating completed work from unfulfilled scope
- Developing and executing a plan to complete the project correctly
- Maintaining detailed written and visual records throughout remediation
This phased approach ensured fairness, clarity, and accountability.
Legal Support & Outcome
The construction documentation and visual records prepared by PG38 Development were provided to the owner’s legal team after resolution efforts failed.
These materials:
- Established a clear record of contractor non-performance
- Documented deficiencies and incomplete scope
- Supported the owner’s position with objective, construction-based evidence
The documentation contributed to the owner’s ability to successfully recoup losses through legal action. PG38 Development did not provide legal services, but its reporting played a critical supporting role.

Closing Perspective
Not every construction issue begins as a dispute. In many cases, owners simply want clarity, accountability, and a path forward that avoids unnecessary escalation. PG38 Development was first engaged on this project to help resolve differences and restore progress in good faith.
When those efforts failed due to contractor non-performance, our responsibility shifted. The focus became stabilizing the project, documenting conditions accurately, completing the remaining work correctly, and ensuring the owner had the information needed to protect their interests.
This project reinforces an important truth for property owners: early intervention, objective documentation, and experienced construction leadership can make the difference between compounding losses and meaningful resolution. PG38 Development exists to step in at those moments and bring clarity when it matters most.
